1. Scope of Agreement
These Terms and Conditions govern all construction estimation services, architectural planning drafting, and contracting works undertaken by LAC Constructions. By requesting a quote, submitting project requirements via our site, or executing a service agreement, you consent to these terms in full.
2. Estimation & BOQ Variations
All project estimates, material calculations, and Bill of Quantities (BOQ) drafts provided by LAC Constructions are based on architectural details, ground reports, and load requirements provided by the client.
LAC Constructions guarantees that structural quantities correspond precisely to supplied blueprints. However, physical ground variations, municipal zoning changes, or adjustments requested during building execution will result in an updated contract variation. All contract variations must be mutually signed off before adjustments are executed on-site.
3. Billing & Milestone Payments
Unless stated otherwise in specific execution contracts, all contracting projects adhere to a progressive billing schedule:
- Advance Mobilization: A percentage (typically 20% to 30%) is billed before site setup and material procurement begins.
- Progressive Billing: Invoices are generated at key structural milestones (foundation pour, slab completions, MEP plumbing framing, finishes).
- Retention Sum: A standard retention sum (e.g. 5%) is held for the duration of the Defects Liability Period (DLP) to cover any structural touch-ups.
4. On-Site Access & Security
To maintain our 100% accident-free record, LAC Constructions retains absolute control over the construction site perimeter. Authorized personnel, sub-contractors, and site supervisors are the only parties allowed inside construction boundaries during operational hours. Client site inspections must be scheduled 24 hours in advance and accompanied by a certified LAC safety superintendent wearing standard Personal Protective Equipment (PPE).
5. Intellectual Property Rights
Architectural drafts, spatial layout renders, engineering calculations, and custom structural designs generated by LAC Constructions before contract execution remain the intellectual property of LAC. Upon final settlement of invoices, intellectual licenses and as-built drawings are transferred to the client for maintenance and facility operations.
6. Jurisdiction & Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Sri Lanka. Any disputes, contract breaches, or quality reviews arising from or related to the services of LAC Constructions will be resolved through amicable bilateral discussions. If an agreement cannot be reached, the dispute will be referred to arbitration in accordance with CIDA guidelines and the Arbitration Act of Sri Lanka.
